Awakening Mediation’s Sleeping Beauty: Can Technology Be the Prince?

As part of the Sleeping Beauty Conference Series (SBCS), this event follows the 10th anniversary of the 2014 Cardozo Journal of Conflict Resolution symposium, which posed the question: Is Mediation a Sleeping Beauty? Despite its proven effectiveness and inherent beauty, mediation appeared then underutilized in many countries, often leaving it in a near-comatose state.
The first part of the conference will unveil fresh data and insights from the forthcoming Rebooting Mediation study, an update of the 2014 EU Parliament study aimed at awakening mediation. The 2024 study edition draws from responses from over 3,000 ADR professionals across the EU, providing data-driven evidence of what is working and where challenges remain. A significant portion of the data comes from Spain, adding weight to the analysis and policy recommendations that will be shared during the conference. This session will be conducted in Spanish, without translation.
In the second part, attendees will witness a live mediation simulation, conducted simultaneously by humans and various AI platforms. In a unique twist, AI will generate the dispute itself. Can machine mediators outperform their human counterparts, particularly when navigating legal and cultural complexities? Could technology, rather than improved mediation policies alone, be the key to awakening this sleeping beauty? Or might the opposite be true? This session will be in English, without translation.
